1.1 TASMA Aviation Training is a product of Tasma Life Balance.
These General Terms and Conditions govern the business relationship between Tasma Life Balance (hereinafter referred to as TLB) and its customers (“Customer”) and apply to all TASMA Aviation Training services and products. They are part of all offers, order confirmations and appointment reservations.
1.2 Conflicting or deviating terms and conditions shall not apply, unless otherwise agreed in writing between TLB and it Customers.
2.1 TLB agrees to provide their services with the utmost care.
2.2 For TASMA Crew Support: TLB points out that TASMA Crew Support is a free, active and self-responsible process and certain successes cannot be guaranteed. The TASMA coach
supports the Customer in particular as process facilitator and supporter of decisions and changes. The actual work to make a change is done by the Customer himself. The Customer should therefore
be willing and open to deal with himself and his situation.
2.3. TLB and its Customers commit each other to loyalty and openness. Both sides do everything to the best of their knowledge and belief in order to make the success of the agreed service
possible.
2.4. The Customer is solely responsible for the use and implementation of the crew support, training and coaching results.
2.5 If the services are to be performed by TLB at the Customer’s premises (head office/training center) or any other agreed location (other than TASMA Aviation Training location in Bern-Belp/
Switzerland or Online), additional required travel cost and expenses shall be payable by Customer. Furthermore, Customer shall make available free of charge reasonable office space, conference or
training facilities, telephone and internet connection, as far as applicable and required.
3.1 The registration for all our services takes place via an online registration form or in writing. By submitting the electronic registration form, e-mail or by post, you are binding and agree
to the terms and conditions. Your TASMA training, apprenticeship or crew support appointment for individuals is binding reserved as soon as your application has been submitted in
writing and you have received a confirmation. This creates a legally binding contract between the Customer and TLB.
3.2 TLB attaches importance to a serious clarification according to the companies needs and tailor-made offers for TASMA trainings, crew support, lectures and other services.
Scope of the contract, as well as the detailed objectives, are specified in a separate agreement. At the beginning of a process, TLB together with the company clarifies the respective
expectations of the TASMA training or crew support. The hourly rates are recorded separately in the agreement.
4.1 The current TASMA Training/Crew Support and Certified Coach fees for open trainings and support at TASMA Aviation Training in Switzerland and Online, can be found on the TASMA Aviation
Training website. For tailor-made on-site TASMA Training/Crew Support and other services, our Customers receive prices in a detailed offer.
4.2 TLB has the right to require advance payments and/or partial payments depending on the contract volume and duration, and such advance payments shall be specified in the TLB quotation and are
accepted by Customer with the related order confirmation.
4.3 Unless otherwise agreed, all payments shall be made by Customer within 10 days after the invoice date without deduction. If the Customer is in default of a timely payment of the invoice, TLB
may charge interest for late payment at 5% per year.
For online enrollment the payment is due 10 (ten) days before the beginning of the course. Decisive is the receipt of money on our account. The right to participate in the TASMA Training/Crew
Support is only valid upon full payment of the invoice amount, if there is no other written agreement.
4.4 Payment shall be made by Customer in accordance with the payment terms, in the currency and to the bank account as specified on the invoice. Customers undertake to pay the invoices within the
agreed payment period.
4.4 As a Swiss Company we usually invoice all our services in CHF. For Payment in foreign currencies the exchange rate of the invoice date is relevant. For payments from abroad, please note that
additional transfer fees may apply to foreign transfers. No cash or debit card payments accepted.
4.5 TLB has the right to issue invoices in electronic format, and Customer shall accept electronic invoices as official invoices for payment.
4.6 For all services subject to VAT, TLB additionally charges the statutory VAT amount.
4.7 On-site training/crew support for airlines/aviation companies: If the TASMA Training and Crew Support does not take place at the location determined by TLB, TLB will bill the
travel expenses, any food and accommodation costs as well as the travel time. The services will be charged according to the effort actually made. In each case, the current fee and performance
overview applies. Expenses (such as room rental, use of special working tools and other extraneous costs) will be discussed with the customer in advance and invoiced by TLB.
4.8 Training Certificate: After training or course completion participants will either receive a “Certificate of Attendance” or a “Certificate of Achievement”. The certificate
will be issued after receipt of payment and if the participant has attended at least 90% of the class.
5.1 TASMA Crew Support sessions at TASMA Aviation Training in Switzerland or Online support:
A free cancellation/reschedule of the crew support session is possible up to 24 hours before the appointment (if the appointment is on Monday cancellation/rescheduling has to be done until the
preceding Friday 12.00h) after the full-fee is due.
5.2 TASMA Trainings/Certified TASMA Coach Training/Lectures/on-site Crew Support:
With resignation after the registration we raise the following fees after receipt of the written declaration of cancellation:
5.3 Replacement: A replacement participant can be nominated only for TASMA Trainings and TASMA Crew Support until 2 days before training/support commencement. Please inform our
training department by email about personal details of the replacement.
6.1 Program changes are reserved for TLB. In principle, TLB has the right to cancel training/support sessions/lectures without substitution (this includes cancellation due insufficient number of
participants). The training/support participants will be punctual informed and will receive back all already paid training fees. Further compensation cannot be claimed.
6.2 In case of illness of the trainer/coach or other unforeseen events (accident etc.) that make the use of the specified trainer/coach impossible, TLB is authorized to appoint another qualified
trainer/coach for the training/support days concerned or to re-schedule the training/support at the earliest possible date.
6.3 For training, courses and seminars, TLB has the right to change the content of services should it appear necessary for technical reasons, such as updates, further developments or didactic
optimization. TLB shall have the right to exchange lecturers announced for a specific course or seminar by equally qualified lecturers.
6.3 TLB reserves the right to adjust performance dates and locations. The Customer will be punctual informed.
7.1 Price changes in the future are reserved for TLB.
7.2 For on-site training/crew support at the Customer premises unless otherwise stipulated in the contract, prices for services are stipulated in the contract and remain fixed for the duration of
the contract. Any changes to the contracted work scope, as mutually agreed in writing, may result in a price adjustment.
7.3 Training price for open training/courses/seminars/lectures held at the premises of TLB in Switzerland include seminar documentation, certificate of participation/achievement, snacks and
refreshments. Hotel accommodation is excluded and shall be booked by the Customer.
8.1 For the purposes of our business, TLB uses generally available technical and methodical knowledge, knowledge acquired from other sources, and knowledge that has been further developed by TLB
itself and adapted to special customer relationships.
8.2 If specialist and methodical knowledge is taken over from other sources, this is declared in the sense of a quotation, or there is a corresponding agreement between TLB and the owner of the
copyright.
The rights to all work results and to all other materials provided by TLB to the Customer shall remain exclusively with TLB to the extent permitted by applicable law. To the extent that TLB
utilizes any third party material for the performance of its services, the affected part of the services shall be subject to the conditions of use stipulated by the relevant third party.
8.3 Any training material provided by TLB shall only be used for the purpose of education and training of the Customer, and shall not be forwarded or otherwise be made available by Customer to
third parties. The provision of access codes to web based training and course documentation, shall only be used by Customer for the Customer’s employees registered for the training/course;
transfer or any other provision of access codes to third parties is prohibited.
8.4 TLB claims the copyright on all its own documents, regardless of whether a corresponding copyright notice is attached to the document concerned.
8.5 TLB or any other party’s notices, brands or trademarks shall not be removed by Customer from any documents or materials provided by TLB.
9.1 TLB treats all company and personal data it receives in connection with its activities or that it generates through its activities, in complete confidence. TLB does not pass these on to third parties. Exceptions are permitted if an organization or individual explicitly authorizes TLB to do so.
9.2 TLB treats personal data with the utmost care. When individual personal reports are made on individual members of an organization, TLB considers those individuals the sole beneficiaries of
that information, regardless of who has placed or pays the order.
9.3 Reports or information to other persons, in particular to other members of the organization and/or supervisors, will only be given with the consent of the authorized person.
10.1 The activity of TLB is a pure service activity. Success is therefore not guaranteed. A (success) liability is excluded. TLB shall be liable exclusively for damage caused by it or its
employees intentionally or through gross negligence. Any further liability, as well as for indirect or consequential damages, is excluded.
10.2 TLB takes over no liability for accident and theft during training, courses, support or events. Insurance is the responsibility of the participants.
10.3 The shipment or electronic transmission of any data is at the risk of the Customer.
11.1 The insurance cover is basically a matter for the Customer.
12.1 For all legal relationships with Tasma Life Balance, Swiss law is applicable.
12.2 Place of jurisdiction for arising disputes is the domicile of Tasma Life Balance, Bern/Switzerland.
